Terms of Service

Before going live: this is a starting template, not a finished legal document. Have a solicitor review and finalise this before real users can create accounts or pay. Replace every [bracketed] placeholder.
What TestSwapDirect is
TestSwapDirect is an independent matching service that helps learner drivers find another learner whose driving test date they'd like to swap. We are not affiliated with, endorsed by, or connected to DVSA or DVLA. We do not access, automate, or modify any DVSA booking system. The actual date change is always made by you, directly with DVSA, using DVSA's own process.
Your responsibilities
- You must provide accurate test and licence details. We only check the format of this information, not its accuracy — you are responsible for what you submit.
- You must be the person named on the licence and booking you list.
- You are responsible for actually contacting DVSA to complete any agreed swap.
- You must not use the service to harass, deceive, or defraud other users.
Payment
Unlocking a matched swap costs a one-time fee of £14.99, charged via Stripe. This is not a subscription — there is no recurring charge. If a match falls through after payment, [insert your actual refund policy here — e.g. "no refund is given, but you may use this unlock towards a new match" or similar].
No guarantee of a match or outcome
We do not guarantee that you will find a match, that a match will result in a completed swap, or that DVSA will approve any specific date change. DVSA's own rules (including any limit on the number of changes allowed per booking) apply regardless of what happens on this service.
Limitation of liability
[Insert your actual liability limitation clause — this section in particular should be drafted or reviewed by a solicitor, as its enforceability depends on UK consumer protection law.]
Account suspension
We may suspend or close accounts that we reasonably believe are being used fraudulently, abusively, or in breach of these terms.
Governing law
These terms are governed by the laws of England and Wales. [Adjust if operating from/targeting Scotland or Northern Ireland specifically.]
